Divorces
In another couple, divorce may have completely different faces.
There are currently in France 4 types of divorce: divorce by mutual consent divorce by acceptance of the principle of marital breakdown, divorce for alteration final marriage, and divorce for misconduct.
Each of these divorces corresponds to a particular context. Divorce by mutual consent is both the fastest and easiest. A single application is submitted to the secretariat-greffe du Tribunal de Grande Instance by both spouses, accompanied by a draft convention. The family court judge approves the agreement if it finds equitable, or submitted in another case, to submit within 6 months.
Divorce litigation takes place quite differently.
For divorces acceptance of the principle of marital breakdown, for final impairment of the marital bond and divorce for fault, 5 major steps along the procedure, the filing of the complaint, conciliation, my implementation of measures, the type of divorce and the presentation of evidence, which is essential particularly in the context of divorce for misconduct. Bridges were in place to standardize the divorces, and allow for example to move from a divorce to a fault divorce final alteration of the marital bond.
Faults divorces are less and less common as they are today rather reserved for cases of domestic violence.
Proof of adultery remains a ground for divorce for fault, but the impact is no longer the amount of child support (which is aimed at children), or the right of custody or visitation. Fault divorce have primarily a symbolic key to the victims of violence, and the spouse at fault could be sentenced to pay the costs of the proceedings.
